Hi!

My entire site was stolen containing 361 posts dating from June 2005 to October 2011. Google will remove the offending post in the splog right enough, but ONLY if I submit a DMCA form for EACH INDIVIDUAL URL! OK if it's just a page or two, but there are 352 left to report.

Any ideas?

The odd thing about this splog is there is no revenue to be stolen. Neither I nor they use adverts and there's no commercial content or element. Weird!

Make it clear that their behaviour is not appreciated by you.
Send them complain email. Put a message on your site to let your visitors know someone stole your content. Blog about it, tweet about it. Expose them. Then let the public finish the job (and trust me, we will)

@JB: If you have a registered trademark for your name, then you definitely should send a cease & desist letter. As a matter of fact, it's your duty to ward off any and all trademark infringement, otherwise your term can be claimed as abandoned. But if you don't have a registered trademark, there's little you can do to protect a generic term like "bottom dollar payday."

The issue I keep running into is people using my website name, but linking to competitor sites. Is there any recourse for this or is it just a case where you have to hope the consumer is smart enough to know when they're clicking on a "false" link.

For example, one of the websites I work for is http://www.bottomdollarpayday.com - we provide loans online. Here is one example of someone else using my website name in the link and telling visitors to "apply at bottom dollar payday" but the link directs them somewhere else. http://payday1500now.com/bottom-dollar-payday

This happens all the time and it is so frustrating when spam sites get ranked with my company name!

Should I try sending them a Cease & Desist letter when they're not actually stealing content, just capitalizing off of my name?

@Sundie: To find out who owns a domain, go to GoDaddy, search for that domain name. GoDaddy will tell you it's already taken, so click the "Get Info" link to see who owns the domain name. In your case, fitnesssnob.org is owned by DomainsByProxy.com, which is a private domain registrar that hides the true owner. So you will not be able to easily find who owns that domain without a court order.

So what you should do instead is click the "Report Abuse" link at the top left of the fitnesssnob.org blog. Then in the next screen, report it as a Copyright/Piracy issue that someone has hijacked your blog at fitnesssnob.blogspot.com. Good luck!
